Welcome to Capstone Toys, a division of Capstone Brands (Pty) Ltd ("Capstone Toys", "we", "us", "our"). These Terms & Conditions govern your use of www.capstonetoys.co.za and any purchases made through our website.

By accessing our website or placing an order, you agree to these Terms.

Capstone Toys is an authorised South African distributor and retailer of selected Upper Story products and other toy and game brands.

We grant you a limited, non‑exclusive licence to browse and use this website for personal or business shopping purposes only.

2.2 Prohibited conduct

You may not:

  • copy or reproduce website content without permission

  • misuse or interfere with the website

  • attempt to hack, reverse engineer, or disrupt systems

  • use our branding, images, or trademarks without consent

2.3 Intellectual property

All content, images, product descriptions, logos, and trademarks remain the property of Capstone Toys, Upper Story, or their respective owners.

2.4 Website availability

We aim for continuous availability but cannot guarantee uninterrupted or error‑free access.

3. Products

3.1 Product information

We take care to ensure that descriptions, images, and pricing are accurate. However:

  • colours may vary slightly

  • packaging may change

  • specifications may change without notice

3.2 Toy safety & age suitability

Some toys contain small parts or require supervision. Customers are responsible for:

  • checking age recommendations

  • supervising children appropriately

  • using products safely and as intended

4. Orders

4.1 Placing orders

By placing an order you confirm that:

  • you are 18+ or have guardian consent

  • you are authorised to use the payment method

  • your information is accurate

4.2 Order acceptance

An order becomes binding only once:

  • payment is received, and

  • goods are dispatched

We may cancel orders due to stock shortages, supplier issues, pricing errors, or suspected fraud. A full refund will be issued if cancelled.

4.3 Stock availability

All goods are subject to availability.

5. Pricing & Payment

  • Prices are in South African Rand (ZAR)

  • VAT is included unless stated otherwise

  • Delivery fees are shown at checkout

  • Full payment is required before dispatch

We reserve the right to correct obvious pricing mistakes.

6. Delivery

6.1 Courier services

We use third‑party courier companies for deliveries.

6.2 Delivery times

Delivery times are estimates and not guarantees.

6.3 Risk

Risk passes to you upon delivery to your chosen address.

If items arrive damaged or missing, notify us within 48 hours with photos.

6.4 Address accuracy

We are not responsible for delivery failures due to incorrect addresses supplied by customers.

7. Returns & Refunds (CPA Compliant)

Your rights are protected under the Consumer Protection Act (CPA) and Electronic Communications and Transactions Act (ECT Act).

7.1 7‑Day cooling‑off period

For online purchases, you may return goods within 7 days of delivery for any reason.

Conditions:

  • unused

  • original packaging

  • resellable condition

Return shipping costs are for the customer unless goods are defective or incorrect.

7.2 Defective goods (6‑month warranty)

If goods are defective within 6 months, you may choose:

  • repair

  • replacement

  • refund

Return shipping will be covered by us.

7.3 Incorrect items

If we send the wrong item, we will replace or refund at our cost.

7.4 Non‑returnable items

Certain items may not be returnable once opened for hygiene or safety reasons where clearly indicated.

Refunds are processed within 7–10 working days after inspection.

8. Warranties & Liability

Goods carry all statutory warranties required by South African law.

To the extent permitted by law:

  • our liability is limited to the value of the order, and

  • we are not liable for indirect or consequential losses.

Nothing in these Terms limits your rights under the CPA.

9. Promotions

Promotions and discounts:

  • are subject to availability

  • may not be combined unless stated

  • may be withdrawn at any time

10. Force Majeure

We are not responsible for delays caused by events beyond our reasonable control, including courier disruptions, strikes, supplier delays, or natural disasters.

11. Changes to Terms

We may update these Terms at any time. Updated versions apply to future orders and will be posted on this page.

12. Governing Law

These Terms are governed by South African law. Disputes may be referred to negotiation, mediation, or the appropriate South African court or consumer authority.

Nothing limits your statutory consumer rights.
